1. Definitions

"codereview.au" — the automated compliance review service operated by Performance Solutions Australia Pty Ltd (ABN 51 676 127 272) ("PSA", "we", "us"). "User", "you" — the natural person or organisation using the service. "Output" — any analysis, report, or other artifact generated by the service. "NCC" — the National Construction Code published by the Australian Building Codes Board.

2. Acceptance

By using the service, you accept these Terms. If you sign up for an account you accept them explicitly via tickbox, logged with timestamp + IP + user agent.

3. The service

codereview.au is an automated analysis tool that identifies potential departures from the Deemed-to-Satisfy (DTS) provisions of the National Construction Code in architectural drawings. The service is informational only. It does not constitute, and must not be relied upon as, professional advice, certification, or a Performance Solution. You are solely responsible for verifying the accuracy of all Output and for engaging qualified professionals (registered building surveyors, accredited Performance Solution practitioners, engineers) for any compliance, design, or certification decisions.

4. Automated review accuracy and limitations

The Output is generated by automated systems and may contain errors, omissions, or inaccuracies. You acknowledge that the service may fail to identify departures, may incorrectly flag compliant items, and may misclassify building elements. You agree not to rely on the service as the sole basis for any compliance, design, certification, construction, or commercial decision.

5. Subscription, billing & GST

  • Plans, prices and features are as published on the pricing page.
  • All prices in AUD, exclusive of GST. 10% GST is added at checkout for Australian customers. PSA is GST-registered.
  • Subscriptions auto-renew at the end of each period unless cancelled.
  • Founding member rate: locked in for the life of a continuously active subscription. If your Subscription lapses (cancellation, payment failure beyond grace period), re-subscribing is at standard rates.
  • Payment failures: 3 retry attempts over 21 days. On final failure, access is suspended. You may reactivate at any time before deletion by updating payment.
  • Refund policy: monthly subscriptions — no refunds for the current month, cancel-anytime stops the next month. Annual subscriptions — pro-rata refund within first 30 days; after that, cancel stops auto-renew.
  • Statutory rights under the Australian Consumer Law are not excluded.

6. Acceptable use

  • No reverse-engineering, scraping, or automated bulk submission.
  • No uploading of plans you do not have the right to analyse.
  • No use of the service to circumvent the requirements of any building authority or NCC compliance process.
  • No re-selling or white-labelling the service except as expressly permitted by your Plan (Tier 3 white-label feature).

7. Free check terms

Free checks are rate-limited and subject to a daily aggregate budget. You have no entitlement to any specific level of free-check availability. Free check Output is watermarked, partial (Performance Solution findings only), and not suitable for any compliance or commercial purpose.

8. Intellectual property

You retain ownership of plans uploaded. PSA retains ownership of the service, the Output format, the underlying NCC mapping, the rule engine, and all software. You grant PSA a non-exclusive licence to process uploaded plans for the purpose of providing the service and improving it (de-identified data only).

9. Performance Solution referrals & Odoo handoff

The service may forward your Project to PSA for a Performance Solution quote when the analysis identifies eligible findings. When this occurs, PSA receives the project metadata, identified PS findings, and your contact details for the purpose of preparing a quote. Such forwarding does not commit you to engaging PSA — you are free to engage any qualified practitioner. Any subsequent engagement with PSA for Performance Solution work is governed by a separate written agreement.

10. Liability

To the maximum extent permitted by law, PSA's total liability arising out of or in connection with the service is capped at the fees paid by you in the 12 months preceding the claim. PSA is not liable for indirect, consequential, or special damages, including loss of profits, loss of opportunity, or rework costs. Nothing in this clause excludes or limits any liability that cannot be excluded or limited under the Australian Consumer Law.

11. Indemnity

You indemnify PSA against claims arising from your use of the Output in design, certification, construction, or compliance decisions where such use was inconsistent with these Terms.

12. White-label terms (Tier 3 only)

You may apply your own logo, firm name, and accent colour to generated reports. You warrant that you own or have the right to use the logo and firm name supplied. A small "Powered by codereview.au" attribution is retained on white-labelled reports and may not be removed. The white-label feature must not be used to misrepresent the nature or origin of the Output.

13. Suspension & termination

PSA may suspend or terminate access for breach of these Terms or of the Acceptable Use Policy. You may cancel at any time via your Account billing page.

14. Privacy

Covered by the Privacy Policy, incorporated by reference.

15. Changes

Material changes will be notified at least 30 days in advance by email. Continued use of the service after the effective date constitutes acceptance.

16. Governing law

Victoria, Australia. Exclusive jurisdiction of the courts of that state.
